Terms of Service

1. The Service

Shadey provides a stealth browser API that creates isolated browser sessions with fingerprint protection, behavioral simulation, and proxy routing. Sessions are accessed via REST API or Chrome DevTools Protocol (CDP). The service is designed for legitimate web automation, QA testing, AI agent development, and public data access.

2. Eligibility

You must be at least 18 years old to use Shadey. By creating an account, you represent that you meet this requirement and have the legal authority to agree to these terms.

3. Acceptable Use

You may use Shadey for:

  • AI agent development and testing
  • QA and automated testing
  • Accessing publicly available web content
  • Research and data analysis
  • Competitive intelligence from public sources

You may NOT use Shadey for:

  • Credential stuffing, brute force attacks, or account takeover
  • Accessing accounts or systems you do not own or have authorization to access
  • Distributed denial-of-service (DDoS) attacks or intentional service disruption
  • Scraping behind authenticated paywalls without authorization
  • Circumventing digital rights management (DRM) or paywalls
  • Collecting personal data in violation of GDPR, CCPA, or applicable privacy laws
  • Harassment, stalking, surveillance, or tracking of individuals
  • Fraud, identity theft, or impersonation
  • Any activity that violates applicable laws or regulations

We reserve the right to suspend or terminate accounts engaged in prohibited activity without notice or refund.

4. Your Responsibility

You are solely responsible for how you use Shadey sessions. Shadey is browser infrastructure — we are not responsible for actions you take through browser sessions, including any content accessed, data collected, or websites visited. You are responsible for complying with the terms of service of any website you access through Shadey.

5. Account and API Keys

You are responsible for keeping your API key confidential. All activity under your API key is your responsibility. Do not share API keys. If you believe your key has been compromised, contact us immediately to rotate it.

6. Session Data

Browser sessions are ephemeral by default. When a session ends, the browser instance, fingerprint, proxy assignment, and all associated data are destroyed. Persistent profiles, when explicitly saved by you, retain cookies and browser state until you delete them or they expire after 30 days of inactivity.

7. Billing

Shadey bills per session-minute of usage. The first 50 session-minutes per month are free. After that, usage is billed at the rate displayed on our pricing page. We reserve the right to change pricing with 30 days notice. All fees are non-refundable except where required by law.

8. Rate Limits and Fair Use

Session concurrency and creation rates are limited per plan tier. Abuse of the service — including excessive session creation, resource exhaustion, or circumventing rate limits — may result in immediate suspension.

9. Intellectual Property

Shadey retains all rights to the service, API, software, fingerprint engine, behavioral models, and related technology. You retain ownership of any data you process through the service.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shadey and its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these terms, or your violation of any third party's rights.

11. Takedown and Legal Requests

If we receive a valid complaint or legal request regarding your usage of the service, we will notify you (unless legally prohibited) and may suspend your access pending resolution. We cooperate with law enforcement when required by valid legal process.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. SHADEY DOES NOT GUARANTEE THAT SESSIONS WILL PASS ALL ANTI-BOT SYSTEMS IN ALL CIRCUMSTANCES. DETECTION AVOIDANCE RATES MAY VARY BY TARGET SITE, CONFIGURATION, AND NETWORK CONDITIONS. SHADEY DOES NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE SERVICE.

13. Limitation of Liability

SHADEY'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM. SHADEY SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION.

14. Termination

You may stop using the service at any time. We may suspend or terminate your access for violations of these terms, abuse, non-payment, or legal requirements. Active sessions and saved profiles will be destroyed upon account termination.

15. Governing Law and Disputes

These terms are governed by the laws of the State of Alaska, United States. Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive any right to a jury trial or to participate in a class action.

16. Changes

We may update these terms. Material changes will be communicated via email or the service dashboard with at least 14 days notice. Continued use after changes take effect constitutes acceptance.
